Gobernanza e inteligencia territorial para resolver conflictos limítrofes

Abstract

RESUMEN: Desde que en 1902 se constituyera el Territorio Federal de Quintana Roo en la Península de Yucatán, México, existe una disputa por una franja de tierra superior a los 10 mil 200 km2. Dada la coyuntura política, no se vislumbra una pronta solución al problema, ya que la Suprema Corte de Justicia de la Nación sigue sin pronunciarse al respecto, por la vía contenciosa, y las entidades federativas implicadas no se ponen de acuerdo sobre la delimitación de sus territorios estatales, por la vía de un convenio amistoso. Los pobladores de las localidades ubicadas en la franja en disputa tienen muchas necesidades y, para que éstas sean gestionadas, piden al gobierno más cercano, el municipal, que las atienda. Los Ayuntamientos tienen la intención de satisfacer las demandas de su población, pero temen incurrir en responsabilidades debido al conflicto territorial en curso. La inexistencia de un “modelo de gestión intermunicipal consistente” entre Campeche y Quintana Roo está generando ineficiencia y falta de respuestas oportunas para lograr el desarrollo sostenible de esta área rural y turística del estado mexicano, lo que, a su vez, está generando situaciones de “ausencia de estado” o de “intervención desordenada” del mismo. Por ello, en este libro se propone poner en práctica la gobernanza e inteligencia territorial como soluciones a las consecuencias negativas que se derivan de la disputa territorial sobre la población asentada en el territorio bajo indefinición jurisdiccional

ABSTRACT Since in 1902 the Federal territory of Quintana Roo was established in the Yucatan Peninsula, México, there is a dispute between a strip of land greater than 10.200 km2. Given the political juncture, there´s no early solution to the problem, as the Supreme Court of Justice of the Nation still doesn´t pronounce on it, by the contentious way, and the federal entities involved don´t agree on the delimitation of their state territories, by way of a friendly agreement. The settlers of the communities located in the disputed strip have many needs and, in order for them to be managed, they ask the nearest government, the municipal one, to attend them. The town councils intend to satisfy the demands of their population, but they are afraid to incur responsibility due to the ongoing territorial conflict. The non-existence of a "consistent inter-municipal management model" between Campeche and Quintana Roo is generating inefficiency and lack of timely responses to achieve the sustainable development of this rural and tourist area of the Mexican state, what, in turn, is generating situations of "absence of state" or "disorderly intervention" of the same. For this reason, in this book it is proposed to put into practice territorial governance and intelligence as solutions to the negative consequences that derive from the territorial dispute over the population settled in the territory under jurisdictional uncertainty.
