El círculo restaurativo en materia penitenciaria como medio de reinserción social en el Estado de Jalisco

Abstract

RESUMEN: El trabajo de investigación doctoral titulado “El Círculo Restaurativo en Materia Penitenciaria como Medio de Reinserción Social en el estado de Jalisco” tiene como propósito dar conocer la necesidad de crear un mecanismo de Justicia Restaurativa, mediante mecanismos idóneos para lograr reconstruir el tejido social que se ha dañado a causa de la conducta delictuosa, Los medios alternativos de solución de controversias que se analizan tienen como finalidad entre otras, evitar que la controversia se dirima bajo la jurisdicción de órganos competentes de una determinada materia jurídica; ya sea mediante la restitución a la víctima de sus derechos o la reparación del daño, sin embargo existen otros tantos supuestos que en razón de que no se sometieron a tales medios por acontecerse fuera de las reformas constitucionales en materia de justicia alternativa como la mediación o la conciliación llegaron a juicio y por ende los infractores de la ley se encuentran hoy compurgando una pena privativa de libertad, por tal motivo, la tesis que se plantea es que bajo el cobijo de la Justicia Restaurativa se busque la reinserción de esos infractores a la sociedad mediante la concientización y responsabilización de sus actos, involucrando a la víctima y a la misma comunidad en busca de que de manera colectiva se resuelvan las consecuencias del delito en pro de que no acontezcan más en el futuro. Para ello implementar el círculo restaurativo en materia penitenciaria como medio de reinserción social del delincuente en los centros penitenciarios de Jalisco como parte del tratamiento penitenciario en donde se le muestre las consecuencias particulares de su actuar en su víctima, por tanto se buscaría entonces un encuentro entre víctima y victimario, así como de familiares de ambas partes, acompañados inclusive de miembros de la comunidad que también se vieron afectados con ese hecho ilícito con el acompañamiento de un facilitador, para que éste abra los canales de comunicación necesarios y se entable una conversación en la cual cada de las partes pueda expresar su postura y su sentir para así conocer las razones que llevaron al infractor a delinquir a la par de conocer las consecuencias pisco-emocionales, físicas, económicas y/o materiales que se ocasionaron a la víctima. Esta práctica restaurativa se buscaría implantar en un primer término para que se materialice en el tratamiento penitenciario de aquellos delincuentes que han delinquido por primera vez, y sobre delitos no graves con el fin de iniciar poco a poco la implementación de esta práctica, ya que se pretende que el arrepentimiento del delincuente sea fidedigno y que compurgue la pena, que se le impuso por la comisión de ese hecho ilícito por ser cosa juzgada. Cabe mencionar que en ningún momento se propone ofrecer el circulo restaurativo como un medio que permita al reo concederle un beneficio de libertad anticipada, pues lo que se busca es que lleve un proceso de humanización que le permita retirar de su vida la intención de volver a delinquir y que la aplicación de círculo restaurativo no sea sólo una excusa para fingir un falso arrepentimiento en la búsqueda de salir de prisión. Por consiguiente es importante puntualizar que el círculo restaurativo busca responder todas incógnitas que quedaron inconclusas en el trance de la comisión de delito, lo que le permitirá a la víctima y al delincuente conocer la otra cara de la moneda, permitiéndole a la víctima desahogar todos los sentimientos que guarda al respecto y que su victimario reconozca y acepte la consecuencias de su actos a fin de que no vuelva a delinquir y se reinserte a la sociedad.

ABSTRACT Doctoral research work entitled "Restorative circle in the penitentiary matters as a means of Social reintegration in the State of Jalisco" is intended to make known the need for a restorative justice, through appropriate mechanisms to rebuild the social structure that has been damaged because of the criminal conduct. Alternative means of dispute resolution being discussed, among other purposes, are intended to avoid that the dispute shall be settled under the jurisdiction of competent bodies of a particular legal issue; either through restitution to victim rights or compensation for the injury, but there are other so many assumptions that were not subjected to such means because they were committed outside the constitutional reforms of justice alternative such as mediation or conciliation came to trial and therefore the lawbreakers are today serving a sentence of deprivation of liberty for this reason, the thesis that arises is that under the shelter of restorative justice seeks to bring about the social reintegration of those offenders through awareness and taking responsibility of their actions, including the victim and the community in a collective manner the consequences of the crime are resolved, looking for this offences no longer occur. To implement the restorative circle in penitentiary matters as a means of social reintegration of offenders in prisons in Jalisco as part of treatment in which is displayed the particular consequences of his act on the victim, a meeting was therefore seek between victim and victimizer, as well as relatives of both parties, including members of the community that also were hit with that unlawful act with the accompaniment of a facilitator to open the necessary communication channels and engage in a conversation in which each of the parties can express their stance and his feeling to make known the reasons that led the offender to commit an offence at the same time, to learn about pshyco-emotional, physical and economic consequences and/or damage that is caused to the victim. This restorative practice would seek to implement firstly, materializes in prison treatment of those criminals who have been offence for the first time, and nonserious offences in order to start the implementation of this practice, gradually since intends to repentance of the offender to be trustworthy and the sentence that was imposed by commission of that unlawful act to be served. It is noteworthy that at any time intends to offer the restorative circle as a means allowing the defendant to grant him an early release benefit, what is sought is to take a process of humanization which allows you to withdraw from your life the intention to commit a crime and that the application of restorative circle is not only an excuse to feign a false repentance in the pursuit of getting out of prison. Therefore it is important to point out that the restorative circle seeks to respond all unknowns that remained unfinished in the trance of the crime commission, which will allow the victim and the offender to know the other side of the coin, allowing the victim to vent all the feelings that holds in this regard and that its perpetrator recognizes and accepts the consequences of his actions to not return to crime and reinsert into society.
