Resumen
Este trabajo de investigacion analiza, desde una postura teorica humanista, la
problematica que surge ante la formulacion de reservas incompatibles con el objeto y fin de los tratados sobre derechos humanos. Lo anterior, en el contexto de transformacion y humanizacion que esta atravesando el derecho internacional, y en general, las relaciones internacionales.
El tema de las reservas a tratados internacionales, incluyendo sobre derechos
humanos, fue discutido a profundidad en la Comision de Derecho Internacional de las Naciones Unidas, y en 2011 se aprobo la “Guia de la Practica sobre las Reservas a los Tratados”.
Dentro de este instrumento se reconoce la capacidad de los organos de vigilancia
de los tratados internacionales para evaluar la validez sustantiva de las reservas, pero respecto a los efectos juridicos de estas declaraciones solo se establece que no seran otros que los del acto que las contiene. Es decir, si la declaracion de invalidez esta contenida en una sentencia vinculante y obligatoria emitida por un tribunal internacional, dicha declaracion sera igualmente vinculante y obligatoria; mientras que si la invalidez se
establecio en una recomendacion de un comite de vigilancia de un tratado, entonces la naturaleza de la declaracion de invalidez sera unicamente recomendatoria.
La hipotesis de la que se parte, es que el effet utile de los Tratados Internacionales sobre Derechos Humanos dependera del retiro de las reservas contrarias a su objeto y fin.
El objetivo del presente trabajo de investigacion consiste en establecer los
lineamientos teoricos que determinen cuales deben ser los criterios que regulen la evaluacion de la compatibilidad de las reservas con el objeto y fin de los tratados sobre derechos humanos, por parte de los organos de control o vigilancia de dichos tratados.
Este trabajo pone sobre la mesa del debate la necesidad de contextualizar esta
problematica en una realidad cambiante, no solo del derecho internacional, sino de las relaciones internacionales en general. Se identifica la actividad de los organos de control convencional como actos de autoridad publica internacional, justificando asi la necesidad de su regulacion y proporcionando algunos lineamientos iniciales sobre las características que puede tener dicha regulacion.
Abstract
This study analyzes, from a humanist point of view, the problem that arises from the introduction of reservations that are contrary to the object and purpose of human rights treaties. The above, in the context of transformation and humanization that international law, and in general, international relations, are going through.
The problem of reservations to treaties, including those on human rights, was
profusely discussed by the United Nations Commission on International Law, and in 2011 the Guide to Practice on Reservations to Treaties, was approved.
This instrument, recognizes the capacity of the human rights treaty-based bodies to evaluate the validity of reservations, but regarding the effect of these declarations it only establishes that they will be those of the act that contains them. That is to say, if the declaration of invalidity is contained in a binding judgment by an international court, then that declaration will be equally binding; whereas if that invalidity was established in a
recommendatory resolution by a treaty based committee, then the nature of such invalidity will be only recommendatory.
The hypothesis of this study is that the effet utile of human rights treaties will depend on the withdrawal of the reservations that are contrary to their object and purpose.
The purpose of this investigation is to establish the theoretical guidelines to
determine the criteria that will regulate the evaluation of compatibility of reservations to the object and purpose of human rights treaties, done by treaty-based organs.
This research puts the necessity of contextualizing this problem in a shifting reality, not only for international law, but for international relations in general. It identifies the activity of the treaty based organs as acts of international public authority, thus justifying the
necessity of its regulation and providing some preliminary guidelines on the characteristics that such regulation should have.
