Resumen
La siguiente tesis tiene como objeto realizar una serie de reflexiones sobre un tema de importancia capital en los estudios jurídicos en la actualidad, la defensa de la Constitución. Dicho tema ha sido abordado con gran interés por diversos investigadores en lo que respecta a la Constitución federal, no así lo relativo a la defensa de los ordenamientos locales. De tal suerte que el presente trabajo analiza los principales postulados de la llamada teoría de la defensa de la Constitución, desarrollada de manera especial por Héctor Fix-Zamudio. De igual forma hace referencia a la extensión que dicha defensa posee en relación con los textos constitucionales locales. El primer capítulo se divide en cuatro apartados: uno destinado al estudio de la teoría de la Constitución, otro a la defensa constitucional, uno más analiza los diferentes sistemas de control constitucional y, la última parte estudia la defensa de la Constitución en el ámbito local.
Desde hace varios años el tema del control constitucional se ha proyectado como uno de los de mayor actualidad; no obstante, la mayoría de trabajos sobre este lo abordan desde una perspectiva procesal y enfocada directamente con el presente. Debemos recordar que dicho tema posee hondas raíces en nuestra historia constitucional, por lo que vale la pena resaltar su aspecto histórico tan importante como poco estudiado. En el segundo capítulo del presente trabajo se analiza el control de la constitucionalidad establecido en la Constitución michoacana de 1825. A fin de lograr un mejor desarrollo del tema, éste se aborda desde una perspectiva teórica en la primera parte del estudio, de igual forma se realiza un breve análisis sobre el control constitucional en la carta federal de 1824.
El capítulo tercero contiene un análisis del control constitucional en Michoacán durante la segunda mitad del siglo XIX. Finalmente, el capítulo cuarto describe el desarrollo de la defensa de la Constitución en Michoacán en el siglo XX.
Abstract
The following thesis has as object to illustrate a series of reflections that have been made on an important topic in legal studies in the present time, the constitutions defense. This topic has been addressed with great interest by many researchers in relation to the federal constitution, but not in the regard to the protection of local jurisdictions. There for this paper analyzes the main postulates of the Constitution’s defense theory, with a special intervention by Hector Fix- Zamudio. It also refers to the extension that this defense has related to the local constitutionals texts. The first chapter is divided into four sections: one for the study of the Constitution’s Theory, another for the constitutions defense, the other one analyzes the different constitutional control systems, and the last one part studies the constitutions defense in its local area.
For several years, the subject of constitutional control has been projected as one of those of major current importance; nevertheless, the majority of work approaches it from a procedural perspective and focused directly with the present. We must remember that this issue has deep roots in our constitutional history, so it is worth noting the historical aspect as important as unstudied. At second chapter of the present work there is analyzed the control of constitutionality established in the Constitution of Michoacán of 1825. In order to achieve a better development of the topic, this one is approached from a theoretical perspective in the first part of the study, just as is a brief analysis of the constitutional control in federal charter in 1824.
Third chapter contains an analysis of constitutional control in Michoacán in second half of the nineteenth century. Finally, the fourth chapter describes the development of constitutional defense in the twentieth century in Michoacán.
